  • A property transfer is the official transfer of ownership rights of a property (land, field, residential property, business premises, etc.) from one person to another. This process is carried out at land registry offices affiliated with the General Directorate of Land Registry and Cadastre. To visit a land registry office, you must request an appointment online or by calling 181.

When is a Title Deed Transfer Required?

  • In sales transactions
  • Inheritance
  • In the case of a donation (grant)
  • Property division or post-divorce proceedings

In such cases, a title deed transfer must be carried out. Furthermore, in cases where a title deed transfer is required, the mutual consent of the parties is necessary.

How is a Property Transfer Carried Out?

  1. The parties apply to the Land Registry Office.
  2. The necessary documents are submitted.
  3. Fees and working capital costs are paid.
  4. The sale or donation contract is signed in the presence of a land registry official.
  5. The new title deed is issued in the buyer’s name and delivered.

What Documents Are Required for Land Registry Transfer?

Documents Required from the Parties (Buyer and Seller):

  1. National identity card or Turkish ID card (original and photocopy)
  2. 1 passport-sized photograph (from the seller)
    2 passport-sized photographs (from the buyer – must have been taken within the last 6 months)
  3. Tax number (for foreign nationals)
  4. Residence certificate (may be required by some departments)

Documents relating to the title deed:

  1. The original and photocopy of the title deed
  2. Market value certificate for the property (obtained from the municipality)
  3. Compulsory earthquake insurance (DASK) policy (for residential properties)

Regarding Payments:

  • Stamp duty and revolving capital receipts
    Land registry fee: 4% of the sale price — the buyer and seller generally pay half each, but this depends on the agreement. In addition, a revolving capital fee of 1,183 TL is payable for each land registry transaction.

Important Note:

  • If the transaction is to be carried out by a representative, a power of attorney certified by a notary public is also required.
  • If the title deed transfer procedures are to take place between legal entities, in addition to these documents, a tax certificate and its photocopy, a power of attorney, and a copy of the registry gazette showing the most recent board of directors election must also be prepared.
