What is Judicial Fine?It is the payment to the State Treasury by the convicted person of the amount calculated by multiplying the number of full days determined, which is not less than 5 days and not more than 730 days unless otherwise specified by law, by the amount determined as the equivalent of one day.
The amount of the judicial fine, which is at least 20 and at most 100 Turkish Liras per day, is determined by considering the person’s economic and other personal circumstances.
In the decision, the total number of days used as the basis for determining the judicial fine and the amount determined as the equivalent of one day are shown separately.
The judge, considering the economic and personal circumstances, may grant a period not exceeding one year from the date the judgment becomes final for the person to pay the judicial fine, or may decide that this fine be paid in installments. The installment period cannot exceed two years and the number of installments cannot be less than four. The decision states that if one of the installments is not paid on time, the entire remaining amount will be collected and the unpaid judicial fine will be converted to imprisonment.

Where is the Judicial Fine Paid?
Adli para cezasının ödenebilmesi için öncelikle kesinleşmesi gerekmektedir. İlk derece mahkemesinin veya bölge adliye mahkemesinin vermiş olduğu kararların kanun yolunun kapanmış olması gerekmektedir. Veyahut Yargıtay’a intikal etmiş bir hüküm ise ancak onama kararının arından cezanın ödenmesi mümkün olabilir. Mahkeme kararı kesinleştikten sonra, kararı veren mahkeme, hükmedilen adli para cezasının tahsili için İnfaz Savcılığına tahsil edilmesi amacıyla yazı yazacaktır.

İnfaz Savcılığı, mahkemenin kendisine gönderdiği yazının içeriğine göre, hükmedilen adli para cezasının taksitle veya peşin ödenmesi için ilgilisine “Adli Para Cezası Ödeme Emri” düzenleyecektir. Ödeme emrinin size tebliğinden itibaren hükmedilen adli para cezasını 30 gün içerisinde ödenmesi gerekmektedir. Bu ödeme emrini ile Cumhuriyet Savcılığı İnfaz Bürosu “na başvurulmalıdır. İnfaz Bürosu” nun verdiği yazıyla Vergi Dairesi“ne ödeme yapıldıktan sonra ödeme dekontunu Cumhuriyet Savcılığı İnfaz Bürosuna” teslim edilmelidir. Bu işlemler eksiksiz yerine getirilmez ise adli para cezasının ödenmemesinden kaynaklı cezai yaptırımlar ile karşılaşılma riski ortaya çıkacaktır.

Can a Prison Sentence be Converted to a Judicial Fine?
The conversion of a prison sentence to a judicial fine varies depending on the judge’s discretion and the nature of the crime. However, it can be roughly summarized in a few headings. But in some cases, the judge has no discretionary power.
For example, if the sentence in question is 30 days or less of imprisonment, the judge must convert this sentence to a judicial fine or alternative sanctions. Also, if the person being tried is under 18 or over 65 years old, the judge must convert a prison sentence of 1 year or less to a judicial fine or alternative sanctions.
- Judicial Fine for Intentional Crimes: In intentionally committed crimes, if the amount of the prison sentence is 1 year or less, the prison sentence can be converted to a judicial fine.
- Judicial Fine for Negligent Crimes: For negligently committed crimes, there is no sentence limit for converting the prison sentence to a fine. In negligently committed crimes, the sentence can always be converted to a fine regardless of the amount of the sentence.
- Crimes Committed with Conscious Negligence: Prison sentences imposed for crimes committed with conscious negligence can be converted to fines if they are 1 year or less. However, according to Article 50 of the Turkish Penal Code, the rule of not considering the amount of prison sentence for negligent crimes does not apply in case of conscious negligence.
