What is Judicial Fine?<\/h2>\n\n

What is Judicial Fine?<\/strong>It is the payment to the State Treasury by the convicted person of the amount calculated by multiplying the number of full days determined, which is not less than 5 days and not more than 730 days unless otherwise specified by law, by the amount determined as the equivalent of one day.<\/p>\n\n

The amount of the judicial fine, which is at least 20 and at most 100 Turkish Liras per day, is determined by considering the person’s economic and other personal circumstances.<\/p>\n\n

In the decision, the total number of days used as the basis for determining the judicial fine and the amount determined as the equivalent of one day are shown separately.<\/p>\n\n

The judge, considering the economic and personal circumstances, may grant a period not exceeding one year from the date the judgment becomes final for the person to pay the judicial fine, or may decide that this fine be paid in installments. The installment period cannot exceed two years and the number of installments cannot be less than four. The decision states that if one of the installments is not paid on time, the entire remaining amount will be collected and the unpaid judicial fine will be converted to imprisonment. <\/p>\n\n

Where is the Judicial Fine Paid?<\/h2>\n\n

Adli para cezas\u0131n\u0131n<\/strong> \u00f6denebilmesi i\u00e7in \u00f6ncelikle kesinle\u015fmesi gerekmektedir. \u0130lk derece mahkemesinin veya b\u00f6lge adliye mahkemesinin vermi\u015f oldu\u011fu kararlar\u0131n kanun yolunun kapanm\u0131\u015f olmas\u0131 gerekmektedir. Veyahut Yarg\u0131tay’a intikal etmi\u015f bir h\u00fck\u00fcm ise ancak onama karar\u0131n\u0131n ar\u0131ndan cezan\u0131n \u00f6denmesi m\u00fcmk\u00fcn olabilir. Mahkeme karar\u0131 kesinle\u015ftikten sonra, karar\u0131 veren mahkeme, h\u00fckmedilen adli para cezas\u0131n\u0131n tahsili i\u00e7in \u0130nfaz Savc\u0131l\u0131\u011f\u0131na tahsil edilmesi amac\u0131yla yaz\u0131 yazacakt\u0131r. <\/p>\n\n

Can a Prison Sentence be Converted to a Judicial Fine?<\/h2>\n\n

The conversion of a prison sentence to a judicial fine varies depending on the judge’s discretion and the nature of the crime. However, it can be roughly summarized in a few headings. But in some cases, the judge has no discretionary power. <\/p>\n\n

For example, if the sentence in question is 30 days or less of imprisonment, the judge must convert this sentence to a judicial fine or alternative sanctions. Also, if the person being tried is under 18 or over 65 years old, the judge must convert a prison sentence of 1 year or less to a judicial fine<\/strong><\/em> or alternative sanctions. <\/p>\n\n
